1. Geographic Restrictions – The Services are for United States Residents

We provide the Services for use primarily by persons located in the country of United States. We make no claims that the Services or any content is accessible or appropriate outside of the United States. Access to the Services may not be legal by certain persons or in certain countries. If you access the Services from outside of the United States, then you do so on your own initiative and are responsible for compliance with local laws.

2. Children Under the Age of 18

The Services are not intended for children under 18 years of age. No one under age 18 may provide any information to, through or on the Services. We do not knowingly collect personal information from children under 18. If you are under 18, then do not: (i) use or provide any information to the Services or on or through any of its features; (ii) register on the Services; (iii) make any purchases through the Services; (iv) use any of the interactive or public comment features of the Services; or (v) provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn that we have collected or received personal information from a child under 18 without verification of parental consent, then we will delete that information. 3. Information We Collect About You and How We Collect It

This includes information provided at the time of submitting information to us through Website forms, registering to use the Services, subscribing to the Services, posting material, requesting further services and making payments. You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Services, or transmitted to other users of the Services or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we may limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Services with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through, use and interact with the Services, we may use automatic data collection technologies to collect certain information about your use of the Services, including your equipment, browsing actions and patterns, including:

We may derive information or draw inferences about you based on the information we collect. 7. How We Handle Your Social and Third-Party Account Logins

The Services may offer to you from time to time the ability to register and login to your account using your third-party social media, cloud and/or other third-party account details. If you choose to register or log into the Services using such account(s), then we may have access to certain information about you. Where you choose to do this, we will receive certain profile information about you from your account provider. Such profile information may vary depending on the account provider, but often will include your name, e-mail address, friends list, profile picture and other information that you choose to make public. If you login using Facebook, Twitch, Google, iCloud, Dropbox, Box or other social media, cloud or other third-party account, then we may also request access to other permissions related to your account, such as friends, check-ins and likes, and you may choose to grant or deny us access to each individual permission.

Please note that we do not control and are not responsible for other uses of your personal information by your third-party account providers. We recommend that you review their respective privacy policies to understand how they collect, use and share your personal information and how you can set your privacy preferences on their websites and apps.

8. Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or that you provide as described in this privacy policy:

  • To our subsidiaries and affiliates, which include joint venture partners or other companies that we control or that are under common control with us;

  • To contractors, service providers and other third parties that we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.   • If we allow you to create an account, complete account access credentials (user names, account numbers or card numbers combined with required access/security code or password)

9. Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information that you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, then please note that some parts of the Services then may be inaccessible or not function properly;

  • Disclosure of Your Information for Third-Party Advertising.   • Promotional Offers from the Company. If you do not wish to have your email address or other contact information used by the Company to promote our own or third parties’ products or services, then you can opt-out by (i) checking the relevant box located on the form on which we collect your data (i.e., the order form or registration form), (ii) if we allow you to create an account, then by logging into the Services and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes, or (iii) by sending to us an email stating your request to support@rinconinsurance.com. If we have sent to you a promotional email, then you may submit an unsubscribe request to be omitted from future email distributions. This opt out does not apply to information provided to the Company as a result of a Service purchase, warranty registration, product service experience or other transactions; and

  • Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, then you can opt-out by sending us an e-mail stating your request to support@rinconinsurance.com. For certain opt-out functions, you must have your browser set to accept all browser cookies.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

Residents of certain states, such as California, Nevada, Colorado, Virginia and Utah may have additional personal information rights and choices.

10. Accessing and Correcting Your Information

You can review and change your personal information by logging into the Services and visiting your account profile page. You may also send us an email at support@rinconinsurance.com to request access to, correct or delete any personal information that you have provided to us. If we enable you to create a user account to the Services, then we cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe that the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Services, then copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Website users. Residents of certain states, such as California, Nevada, Colorado, Virginia and Utah may have additional personal information rights and choices.

11. Your State Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.

California:

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of the Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Colorado, Connecticut, Virginia and Utah each provide their state residents with rights to:

  • Confirm whether we process their personal information.

  • Access and delete certain personal information.

  • Data portability.

  • Opt-out of personal data processing for targeted advertising and sales.

Colorado, Connecticut and Virginia also provide their state residents with rights to:

  • Correct inaccuracies in their personal information, taking into account the information's nature processing purpose.

  • Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.

Nevada:

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out rights may submit a request to this designated e-mail address: support@rinconinsurance.com. However, please know we do not currently sell data triggering that statute's opt-out requirements.

12. Do Not Track (DNT)

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting that you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communications your choice not to be tracked online.

13. Data Security

We have implemented appropriate technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. All information that you provide to us is stored on our secure servers behind firewalls. Any payment transactions and other sensitive personal information will be encrypted using SSL technology.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Services like message boards, if such public areas are made available to you. The information you share in public areas may be viewed by any user of the Services.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to the Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.

14. Changes to Our Privacy Policy

It is our policy to post any changes that we make to our privacy policy on this. If we make material changes to how we treat our users’ personal information. The date that the privacy policy was last revised is identified at the top of this page. You are responsible for ensuring that we have an up-to-date active and deliverable email address for you, and for periodically visiting the Services and this privacy policy to check for any changes.

Data Transfers

Because the Company is a US-based company, your information will be collected and processed in the United States. Privacy Policy for California Residents

This Privacy Policy for California Residents (this “Policy”) supplements the information contained in the Privacy Policy for Rincon Insurance Agency, Inc. (the “Company,” “we,” “us” or “our”), and applies solely to all visitors, users and others who reside in the State of California (“consumers” or “you”). We adopt this Policy to comply with the California Consumer Privacy Act of 2018 (the “CCPA”) and any terms defined in the CCPA have the same meaning when used in this Policy.

This Policy does not apply to workforce-related personal information collected from California-based employees, job applicants, contractors or similar individuals.

Where noted in this Policy, the CCPA temporarily exempts personal information reflecting a written or verbal business-to-business communication (“B2B personal information”) from some of its requirements.

Information We Collect

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“personal information”). Personal information does not include:

  • Publicly available information from government records;

  • Deidentified or aggregated consumer information; or

  • Information excluded from the CCPA’s scope, such as:

  • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data, or other qualifying research data; and

  • Personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.

In particular, the table below describes the categories of personal information that we have collected from consumers within the last twelve (12) months:

A. Identifiers. A real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, Social Security number, driver’s license number, passport number, or other similar identifiers.

B. Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)). A name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information.

Some personal information included in this category may overlap with other categories.

C. Protected classification characteristics under California or federal law. Age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status, genetic information (including familial genetic information).

D. Commercial information. Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

E. Internet or other similar network activity. Browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement.

F. Geolocation data. Physical location or movements.

G. Inferences drawn from other personal information. Profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

We obtain the categories of personal information listed above from the following categories of sources:

  • Directly from you. For example, from forms you complete or products and services you purchase.

  • Indirectly from you. For example, from observing your actions on our website and use of our products and services.

  • Third parties (with your consent, where required by law).

Use of Personal Information

We may use, sell or disclose the personal information we collect for one or more of the following purposes:

  • To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to request a price quote or ask a question about our products or services, then we will use that personal information to respond to your inquiry. If you provide your personal information to purchase a product or service, then we will use that information to process your payment and facilitate delivery. We may also save your information to facilitate new product orders or process returns.

Sharing Personal Information

We may share your personal information by disclosing it to a third party for a business purpose or sell your personal information, subject to your right to opt-out of those sales. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to keep that personal information confidential and not use it for any purpose except performing the contract.

In the preceding twelve (12) months, Company has disclosed and sold personal information for a business purpose to the categories of third parties indicated in the chart below.

We may also share your personal information by selling it to third parties, subject to your right to opt-out of those sales. Our personal information sales do not include information about individuals we know are under age 16.

The personal information categories include identifiers, California customer records personal information categories, protected classification characteristics under California or federal law, commercial information, internet or other similar network activity, geolocation data, and Inferences drawn from other personal information as similarly described in the company’s Privacy Policy above.

The business purpose disclosures and sales types include but are not limited to: advertising networks, internet service providers, data analytic providers, government entities, operating systems and platforms, social networks, data brokers or aggregators, service providers, affiliates, partners, parent or subsidiary organizations, and internet cookie data recipients.

The CCPA prohibits a third party from reselling personal information unless you have received explicit notice and an opportunity to opt-out of further sales.

Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Right to Know and Data Portability

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve (12) months (the “right to know”). Once we receive your request and confirm your identity, we will disclose to you:

  • The categories of personal information we collected about you.

  • The categories of sources for the personal information we collected about you.

  • Our business or commercial purpose for collecting or selling that personal information.

  • The categories of third parties with whom we share that personal information.

  • The specific pieces of personal information we collected about you (also called a data portability request).

  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:

  • Sales, identifying the personal information categories that each category of recipient purchased; and

  • Disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

We do not provide a right to know or data portability rights for B2B personal information.

Right to Delete and Deletion Requests

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (the “right to delete”). Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law or otherwise perform our contract with you.

  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity or prosecute those responsible for such activities.

  3. Debug products or services to identify and repair errors that impair existing intended functionality.

  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights or exercise another right provided for by law.

  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

  6. Engage in public or peer-reviewed scientific, historical or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.

  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

  8. Comply with a legal obligation.

  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will delete or deidentify personal information not subject to one of these exceptions from our rectors and will direct our service providers to take similar action

We do not provide these deletion rights for B2B personal information.

Exercising Your Access, Data Portability, and Deletion Rights (Rights to Know or Delete)

To exercise your rights to know or delete described above, please submit a request to us by either:

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information. You may also make a request to know or delete on behalf of your minor child.

You may only make request to know twice within a 12-month period. Your request to know or delete must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a request to know or delete does not require you to create an account with us. However, if you do have an account with us, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.

We will only use personal information provided in the request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We strive to confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the ten (10) day timeframe, please contact support@rinconinsurance.com.

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another forty-five (45) days), then we will inform you of the reason and extension period in writing.

If you have an account with us, then we will deliver our written response to that account. If you do not have an account with us, then we will deliver our written response by mail or electronically, at your option.

Any disclosures that we provide will only cover the twelve (12) month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive or manifestly unfounded. If we determine that the request warrants a fee, then we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Personal Information Sales Opt-Out and Opt-In Rights

If you are 16 years of age or older, then you have the right to direct us to not sell your personal information at any time (the “right to opt-out”). We do not sell the personal information of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is at least 13 but not yet 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt-in to personal information sales may opt-out of future sales at any time.

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales at any time by emailing us at support@rinconinsurance.com.

You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.

  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

  • Provide you a different level or quality of goods or services.

  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

Other California Privacy Rights
